Terms of Service

The short version
Memoir Family turns your family's month into a printed booklet mailed to the grandparents, every month, for as long as you subscribe. Your photos stay yours; we only use them to make the issue. You are billed monthly and can skip a month or cancel at any time. Each issue is printed just for you, so it cannot be returned for a change of mind, but if it arrives damaged or misprinted we will make it right. The details follow.
1. Agreement
These terms are a contract between you and Memoir ("we", "us"), a service operated from France. By creating an account, joining a circle or subscribing, you agree to them. If you do not agree, please do not use the service. Questions: support@memoirfamily.com.
2. Your account and your circle
You sign in with a Google or Apple account and must be at least 15 years old, or the age of digital consent where you live. You are responsible for activity on your account. The person who creates a circle is its owner: the owner invites and removes members, names the recipients, approves or skips issues, and holds the subscription. Members can post to the thread and add pages. We may suspend or close accounts that violate these terms or abuse the service; you can stop at any time and delete your account from the app. Deletion is immediate and permanent. Records of orders already placed are kept, as our Privacy Policy explains.
3. Your photos and content
Everything posted to the circle, photos, messages, captions, voice notes, remains the property of whoever posted it. So that the service can work, you grant us a limited, non-exclusive licence to store, copy, resize and process that content, including with automatic editing, and to render and transmit it to our printing partner, solely to provide the service. This licence ends when the content is deleted from our systems.
By posting to a circle you are sharing with its members and, through the printed issue and its web copy, with the recipients. Post only what you have the right to share, including photos of other people, and nothing unlawful. We do not review circles, but we may remove content and refuse to print issues that we are required to by law. Comments are never printed.
4. The monthly issue
- An issue closes on the 25th of each month at 23:59 UTC. Pages added after that go into the next issue.
- An issue with fewer than eight filled pages is skipped: it is not printed and not charged.
- The app proposes pages, tidies captions and drafts the monthly letter. Review the issue before it closes; you can edit anything it did, hold the issue, or skip the month.
- Once the owner has approved an issue by hand, later issues can be sent automatically at the close unless held. The owner can turn this off at any time.
- The printed issue is produced exactly from the pages as they stood at the close.
5. Subscription, billing and cancellation
The plan is billed monthly by our payment processor, in advance, on the date shown at checkout, at the price shown there plus any extra copies you have added for that month. Prices include printing and postage to the countries we ship to. A month you skip, or that is skipped for having too few pages, is not charged.
You can cancel at any time from your subscription page. Cancellation takes effect for the next issue; an issue that has already closed is still printed and shipped. There are no refunds for a partial month. Gift subscriptions are paid once for a fixed number of issues and end after the last one without renewing.
We may change the price with at least thirty days' notice by email; continuing after the change takes effect means you accept the new price.
6. Printing and delivery
Issues are printed by our printing partner and mailed to the recipients' addresses as they stand at the close. Keep them up to date in the app; we cannot redirect an issue once printed. Delivery estimates are estimates, not guarantees.
Because each issue is personalised and made to order, the legal right of withdrawal for distance sales does not apply to a printed issue (in the EU, per Article L221-28 of the French Consumer Code and Directive 2011/83/EU). If an issue arrives damaged, defective or materially different from the closed issue, contact us at support@memoirfamily.com within 30 days of delivery and we will reprint or refund it. Nothing in these terms limits your statutory warranties as a consumer.
7. What we promise, and what we do not
We work hard to keep the service available and your data safe, but it is provided as is: we cannot promise it will be uninterrupted or error-free, and you should keep your own copies of your photos. Memoir Family is not a backup service.
To the extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, or your mandatory rights as a consumer.
8. Changes to the service or these terms
Memoir Family is young and evolving: features may change, improve or be retired. If we make material changes to these terms, we will update the date at the top and notify you in the app or by email; continuing to use the service after that means you accept the new terms.
9. Governing law
These terms are governed by French law. If you are a consumer in the EU, you also benefit from the mandatory consumer protections of the country you live in, and disputes can be brought before the courts of that country.
